Privacy Policy

Pixability, Inc. (“Pixability,” “we,” “us,” or “our”) provides advertising technology and media services that help brands and agencies plan, buy, and measure advertising on YouTube and other video platforms. This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit www.pixability.com and other websites that link to this policy (the “Site”), use the Pixability platform and related tools we make available to customers (the “Platform”), interact with us at events or in the course of business, or are reached by advertising campaigns we manage on behalf of our customers (together, the “Services”). It also describes the choices and rights you have. Our Website Terms of Use govern your use of the Site and incorporate this policy.
1. Scope and our role
Pixability acts in two different capacities, and this policy applies differently depending on which one is involved.
Pixability as a business or controller. When we collect information from visitors to the Site, from prospective and current customers and their personnel, from Platform users, from event attendees, from job applicants, and from vendors, we decide how and why that information is used. This policy applies in full to that information.
Pixability as a service provider or processor. When we plan, run, and report on advertising campaigns for advertisers and agencies, we process campaign data on their instructions under written agreements. Our customers decide what data is used for their campaigns, and their privacy policies govern that data. Pixability’s targeting and reporting operate principally at the level of YouTube channels, videos, and content categories rather than individual viewers, and any viewer-level data we receive from advertising platforms is aggregated or pseudonymous. If you have questions about a campaign run by one of our customers, please contact that advertiser directly; we will assist our customers in responding to your requests as our agreements require.
2. Information we collect
Information you provide to us. We collect information you give us directly, such as your name, job title, employer, business email address, telephone number, and mailing address when you request a demo, download research, subscribe to our newsletter, register for an event or webinar, contact us, or apply for a job; account credentials, profile details, and preferences when you or your employer set up a Platform account; billing and payment information when you become a customer; and the content of your communications with us, including support requests and feedback.
Information we collect automatically. When you use the Site or Platform we and our service providers automatically collect information about your device and activity, such as IP address, browser type and version, operating system, device identifiers, referring URLs, pages viewed, links clicked, time spent, approximate location derived from IP address, and, on the Platform, the features and reports you use and actions you take. We collect this information using cookies, pixels, log files, and similar technologies described in Section 4.
Information from other sources. We receive information from advertising platforms and publishers (including YouTube and Google) about the performance and placement of campaigns we manage; from data, measurement, and verification partners such as brand-safety and viewability vendors; from our customers and their agencies about their personnel who will use the Platform; from business-information providers that help us keep contact records current and identify prospective customers; from social networks when you interact with our pages or content; and from publicly available sources. We may combine information from these sources with information we collect directly.
YouTube and Google API Services. The Platform uses YouTube API Services and other Google APIs. When a customer authorizes Pixability to access its Google Ads, Display & Video 360, YouTube, or other Google accounts (“Advertiser Accounts”), we receive the account and campaign data that authorization permits. By using those features you agree to be bound by the YouTube Terms of Service (www.youtube.com/t/terms), and the Google Privacy Policy (policies.google.com/privacy) applies to Google’s handling of your data. Pixability’s use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy (developers.google.com/terms/api-services-user-data-policy), including the Limited Use requirements. You can revoke Pixability’s access to an Advertiser Account at any time through the Google security settings page at myaccount.google.com/permissions.
3. How we use information
We use personal information to provide, operate, secure, and improve the Site, Platform, and Services; to set up and administer accounts, authenticate users, and provide customer support; to plan, execute, optimize, measure, and report on advertising campaigns for our customers; to process payments, manage billing, and maintain business records; to respond to your inquiries and requests; to send administrative messages about your account or our Services; to send marketing communications, research, event invitations, and newsletters where permitted by law (you may opt out at any time as described in Section 9); to analyze how the Site and Platform are used and to develop new features and services; to detect, investigate, and prevent fraud, abuse, security incidents, and other harmful activity; to comply with legal obligations and enforce our agreements; to evaluate job applications; and for any other purpose described to you at the time of collection or to which you consent.
We may create aggregated, de-identified, or anonymized data from personal information and use that data for any lawful purpose, including industry research and benchmarking, provided we do not attempt to re-identify it.
4. Cookies and similar technologies
We and our service providers use cookies, pixels, tags, local storage, and similar technologies on the Site and Platform. These technologies fall into the following categories: strictly necessary (required for the Site and Platform to work, including login and security); functional (remembering your preferences and settings); analytics (understanding how visitors use the Site so we can improve it, for example through Google Analytics and our marketing-automation provider); and advertising (measuring the effectiveness of our own marketing and, where enabled, showing you Pixability advertising on other sites based on your visit).
You can control cookies through your browser settings, which typically allow you to refuse or delete cookies; disabling cookies may affect how the Site and Platform function. Where required by law, including for visitors from the European Economic Area, United Kingdom, and Switzerland, we obtain your consent through a cookie banner before setting non-essential cookies, and you may change your choices at any time through the cookie-preferences link on the Site. We honor Global Privacy Control signals as an opt-out of any sale or sharing of personal information and of targeted advertising, where applicable law requires. Because there is no industry consensus on how to respond to browser “Do Not Track” signals, we do not currently respond to them. To opt out of Google Analytics, you can install the Google Analytics opt-out browser add-on. You can learn about interest-based advertising opt-outs at optout.aboutads.info and optout.networkadvertising.org.
5. How we disclose information
We disclose personal information in the following circumstances. Service providers: to vendors that perform services on our behalf, such as cloud hosting, data storage, analytics, customer-relationship management, marketing automation, email delivery, payment processing, security, and professional services, under contracts that restrict their use of the information to providing those services. Advertising and measurement partners: in connection with campaigns we manage, to advertising platforms, demand-side platforms, exchanges, publishers, and verification and measurement vendors, as needed to run and report on the campaign. Our customers: we share campaign data and reports with the advertiser or agency for whom the campaign is run, and we share Platform user information with the customer organization that administers the account. Affiliates: with our corporate affiliates for the purposes described in this policy. Legal and safety: when we believe disclosure is required by law, regulation, subpoena, or legal process, or is necessary to protect the rights, property, or safety of Pixability, our customers, or others, to investigate fraud or security issues, or to enforce our agreements. Corporate transactions: in connection with a merger, acquisition, financing, reorganization, sale of assets, bankruptcy, or similar transaction, in which case your information may be transferred to the successor or acquirer, subject to this policy. With your consent or at your direction: for example, when you ask us to share information with a partner at an event.
We do not sell personal information, and we do not share it with third parties for their own direct-marketing purposes. See Section 10 for how these terms are defined under US state privacy laws.
6. Data retention
We retain personal information for as long as needed to fulfill the purposes described in this policy, including to provide the Services, maintain business and financial records, resolve disputes, and comply with legal obligations. The retention period depends on the type of information, the purpose for which it was collected, applicable legal and contractual requirements, and the sensitivity of the data. Campaign data processed on behalf of customers is retained in accordance with our agreements with them. When personal information is no longer needed we delete it or de-identify it so that it can no longer be associated with you.
7. Security
We maintain administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, alteration, and disclosure, including access controls, encryption of data in transit, and security monitoring. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security. You are responsible for keeping your Platform credentials confidential and for notifying us promptly at the address in Section 13 if you believe your account has been compromised.
8. International data transfers
Pixability is headquartered in the United States, and personal information we collect is stored and processed in the United States and in other countries where we or our service providers operate. Those countries may have data-protection laws that differ from those of your country. Where we transfer personal information from the European Economic Area, United Kingdom, or Switzerland to a country that has not been found to provide an adequate level of protection, we rely on appropriate safeguards such as the European Commission’s Standard Contractual Clauses and the UK International Data Transfer Addendum. You may request a copy of the relevant safeguards by contacting us as described in Section 13.
9. Your choices
Marketing communications. You may opt out of marketing emails at any time by using the unsubscribe link in any message or by contacting us. We may continue to send you non-promotional messages about your account or our business relationship. Cookies and tracking. See Section 4. Platform accounts. Platform users can review and update their profile information through account settings or by contacting their organization’s administrator. Advertiser Accounts. Customers can revoke Pixability’s access to Google accounts at any time as described in Section 2. Rights requests. Depending on where you live, you may have the rights described in Sections 10 and 11. Anyone may contact us to request access to, correction of, or deletion of their personal information, and we will respond in accordance with applicable law.
10. Additional information for US residents
This section applies to residents of California, Colorado, Connecticut, Virginia, Utah, Texas, Oregon, Montana, and other US states with comprehensive privacy laws, to the extent those laws apply to Pixability. Many of these laws exempt information collected in a business-to-business context or in the course of employment; we honor requests from any US resident to the extent required by the law of their state.
Categories of personal information. In the twelve months before the effective date of this policy we collected the following categories of personal information, as defined by the California Consumer Privacy Act: identifiers (such as name, email address, IP address, and account identifiers); customer records (such as billing address and payment details); professional or employment-related information (such as employer and job title); commercial information (such as Services purchased and campaign history); internet or other electronic network activity (such as browsing and Platform usage data); approximate geolocation derived from IP address; audio or visual information (such as recordings of webinars or support calls, where you are notified); and inferences drawn from the foregoing to understand your professional interests. We collect these categories from the sources, and use and disclose them for the business purposes, described in Sections 2, 3, and 5. We do not collect sensitive personal information as defined by the CCPA except account login credentials, which we use only to provide the Platform.
Sale and sharing. We do not sell personal information and have not done so in the preceding twelve months. We do not share personal information for cross-context behavioral advertising. We do not knowingly sell or share the personal information of anyone under 16. We do not use or disclose sensitive personal information for purposes other than those permitted by law.
Your rights. Subject to applicable law and certain exceptions, you have the right to know what personal information we collect, use, and disclose about you, including the categories of sources and of third parties to whom it is disclosed; to access a copy of the personal information we hold about you, in a portable format; to correct inaccurate personal information; to delete personal information we collected from you; to opt out of the sale or sharing of personal information and of targeted advertising and profiling in furtherance of decisions that produce legal or similarly significant effects (we do not engage in those activities); and not to be discriminated against for exercising your rights.
How to exercise your rights. You may submit a request by emailing legal@pixability.com or by writing to the address in Section 13. We will verify your identity by matching the information in your request with information we hold and may ask for additional information to do so. You may designate an authorized agent to submit a request on your behalf; we may require proof of the agent’s authority and may contact you directly to confirm. We will respond within 45 days, and may extend that period by a further 45 days where reasonably necessary, in which case we will notify you. If we deny your request you may appeal by replying to our response with the word “appeal,” and we will respond to your appeal within the time required by your state’s law; if your appeal is denied, you may contact your state attorney general. Shine the Light. California residents may request a list of the third parties to which we have disclosed personal information for their own direct-marketing purposes during the preceding calendar year; as stated above, we do not make such disclosures.
11. Additional information for individuals in the EEA, UK, and Switzerland
If you are in the European Economic Area, United Kingdom, or Switzerland, the following additional information applies to personal data for which Pixability is the controller. Pixability, Inc., 125 High Street, Boston, MA 02110, USA, is the controller.
Legal bases. We process personal data on the following legal bases: performance of a contract, where processing is necessary to provide the Site, Platform, or Services to you or your organization, or to take steps at your request before entering a contract; our legitimate interests, including operating, securing, and improving the Services, marketing to business contacts, conducting analytics, preventing fraud, and managing our business, provided those interests are not overridden by your rights; compliance with a legal obligation; and your consent, where we ask for it, for example for non-essential cookies or certain marketing, which you may withdraw at any time without affecting the lawfulness of processing before withdrawal.
Your rights. Subject to applicable law, you have the right to request access to your personal data; rectification of inaccurate data; erasure; restriction of processing; data portability; and to object to processing based on our legitimate interests, including the right to object at any time to direct marketing. You may exercise these rights by contacting us as described in Section 13. You also have the right to lodge a complaint with the data-protection supervisory authority in the country where you live or work or where you believe an infringement occurred; in the UK, this is the Information Commissioner’s Office (ico.org.uk).
Transfers. See Section 8.
12. Children’s privacy
The Site and Platform are intended for business users and are not directed to children. We do not knowingly collect personal information from anyone under 16, and we do not knowingly sell or share the personal information of minors. If you believe a child has provided us with personal information, please contact us and we will delete it. In managing advertising campaigns, Pixability follows YouTube’s and Google’s policies regarding advertising to minors and content made for kids, and requires its customers to comply with applicable children’s advertising laws, including the Children’s Online Privacy Protection Act.

14. Changes to this policy
We may update this policy from time to time to reflect changes in our practices, technology, or legal requirements. When we do, we will post the revised policy on the Site with a new effective date and, if the changes are material, provide additional notice such as a statement on the Site or an email to account holders. Your continued use of the Services after the effective date of a revised policy means you accept the changes, to the extent permitted by law.
